Fosamax Lawsuits: Leg Injury Femur Fracture Litigation Update: Legal And Medical
Fosamax Use Has Been Associated With Atypical Low Stress Breaks, Or Insufficiency Fractures, Of The Femur / Thigh Bone
We will start with the legal update of Fosamax femur fracture lawsuits filed against Merck.
As of September 2012 there are approximately 1500 Fosamax leg injury lawsuits, total, involving low stress fractures of the femur or thigh bone.
More than 600 of these lawsuits are pending in the Fosamax multidistrict litigation (MDL) for these femur fracture cases -- IN RE: FOSAMAX (ALENDRONATE SODIUM) PRODUCTS LIABILITY LITIGATION (NO. II), MDL No. 2243 -- with federal district court Judge Joel Pisano in New Jersey assigned to preside.
Another estimated 900 Fosamax lawsuits involving femur fractures have been filed in New Jersey (NJ) state court "Mass Tort" consolidation; these leg injury cases are pending before Judge Carol Higbee in Atlantic County Superior Court.
In the summer of 2012 Judge Higbee announced that the next Fosamax trial in NJ state court would be for a femur fracture leg injury lawsuit, instead a osteonecrosis of the jaw (ONJ) case as was originally scheduled. As a result of this change in plan by Judge Higbee, it is expected that the first Fosamax femur fracture trial will be in Atlantic County, NJ.
