YAZ / Yasmin / Ocella MDL Update October 2010: Bellwether, or Early Trial, Cases Set To Begin In September 2011 Per Judge Herndon Order

More Than 3700 Lawsuits Filed To Date: 41% Are Venous Thromboembolisms (VTE), Including Pulmonary Embolisms (PE) And Deep Vein Thrombosis (DVT); 43% Are Gallbladder Injuries; 10% Are Strokes And Heart Attacks / Myocardial Infarctions (MI)

January 2012 Update: The January 9, 2012 Sims v. Bayer "bellwether", or test, trial has been postponed indefintely, and Judge David Herndon has ordered mediation for the entire Yasmin and YAZ MDL litigation in order to see if some or all of these federal court lawsuits can be settled.

May 2011 UpdateYasmin / YAZ MDL: First Trial Moved From September 2011 To January 2012 Per Plaintiffs' Request

In May 2011 federal court Judge David R. Herndon announced that the first trial in MDL 2100 -- Yasmin and YAZ (Drospirenone) Marketing, Sales Practices and Products Liability Litigation -- will start in January 2012 and that it will be a pulmonary embolism case. At the time, there were more than 6600 YAZ / Yasmin / Ocella lawsuits filed in the MDL on behalf of more than 8000 plaintiffs.



February 2011 Update: The Number Of Birth Control Lawsuits Filed Against Bayer Now Exceeds 6000

As of February 16, 2011 there were 5353 cases filed in MDL No. 2100 -- IN RE: Yasmin and Yaz (Drospirenone) Marketing and Sales Practices and Products Liability Litigation -- pending in the Southern District of Illinois.

As of January 1, 2011 there were 765 lawsuits filed in the New Jersey "mass tort" consolidation -- IN RE Yaz, Yasmin, Ocella Litigation -- pending in the Superior Court of New Jersey, Law Division, in Bergen County.


On October 13, 2010 Judge David Herndon, who is presiding over the federal court YAZ / Yasmin / Ocella MDL litigation, entered AMENDED CASE MANAGEMENT ORDER NO. 24 -- BELLWETHER TRIAL SELECTION PLAN (PDF file).

This Amended Order No. 24 established that there will be three bellwether cases, or early trial dates, as seen below:

13. The first trial is set September 12, 2011. This will be a pulmonary embolism (PE) case.

14. The second trial is set January 9, 2012. This will be a gallbladder (GB) case.

15. The third trial is set April 2, 2012. This will be an additional thromboembolic (VTE) case.

Further, this MDL Bellwether Trial Selection Plan Order provided some information about the number of YAZ / Yasmin / Ocella lawsuits currently filed in the federal court MDL as well as the disease-category "mix" for these personal injury and wrongful death cases:

  • Currently, there are well in excess of 3700 filed cases in this district and the number grows by leaps and bounds every month.
  • While stroke and heart attack cases make up nine to ten percent of the cases, the parties have agreed not to include that group in the bellwether trials, in part, because those numbers pale in comparison to the other alleged ailments. Venus [sic] thromboembolisms (VTE) (which include pulmonary embolisms and deep vein thromboses) make up forty to forty-one percent; while gallbladder injuries account for the remaining forty-three percent of the alleged harms caused by the pharmaceuticals at issue.

Just two months earlier, in August 2010, the total number of Yaz / Yasmin / Ocella lawsuits filed in the MDL was approximately 2600 cases.

Previously, in March 2010 Bayer had stated that there were more than 1,100 Yaz / Yasmin / Ocella lawsuits filed in the federal court system and various state courts around the country.
