After losing the first Vioxx trial in Texas in August 2005, Merck's general counsel was quoted in The New York Times saying that Merck has recently expressed a willingness to consider making Vioxx settlements out of court on a case by case basis. As of August 2005, almost 5,000 Vioxx cases were already filed in courts around the country.

When filing Vioxx claims, it is important to remember that all states have statutes of limitations which determine the time period allowed to file a Vioxx lawsuit. The applicable statute of limitation, or deadline to file claims, varies from state to state, and the personal injury statute of limitation deadline can be different from the wrongful death statute of limitation deadline within the same state. For example, in some states a personal injury claim must be filed within 3 years from the date the Vioxx side effect or adverse drug reaction is diagnosed, while a wrongful death claim must be filed within 2 years from the date of a death caused by Vioxx. In some states, the statutes of limitations may be as short as 1 year from the date of diagnosis or death.
